This End User License Agreement ("Agreement") is between Smith Creative Technology ("we," "us," or "our") and you ("Licensee"). By downloading, installing, or using Show Caller, you agree to be bound by this Agreement.
Subject to this Agreement and payment of the applicable license fee, we grant you a limited, non-exclusive, non-transferable, worldwide license to install and use Show Caller on up to three (3) Mac computers that you own or control, for your personal or professional live event production activities.
We offer a 14-day free trial with full feature access. No payment is required to begin a trial. Continued use after the trial period requires purchase of a license.
Your license is valid for one (1) year from the date of purchase. At expiry, Show Caller will continue to function but will no longer receive updates or support until renewed. We will notify you before your license expires.
Your license covers up to three (3) machine activations. You may deactivate a machine to free a slot. Activations may not be shared with other individuals or organizations.
You may not copy, modify, distribute, reverse engineer, decompile, rent, lease, sell, or sublicense Show Caller. You may not use Show Caller to develop a competing product or remove any proprietary notices.
Show Caller is proprietary to Smith Creative Technology. All rights not specifically granted herein are reserved.
Show Caller runs as a local server on your network. We do not collect, store, or transmit your show data or rundowns. We collect only license activation status to validate your license. See our Privacy Policy for full details.
During your active license term, you will receive all software updates at no additional charge. Email support is provided at support@showcaller.io on a reasonable efforts basis.
Show Caller is provided "as is" without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Smith Creative Technology shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid in the twelve (12) months preceding the claim.
We may terminate this Agreement immediately upon breach. Upon termination, you must cease all use of Show Caller and destroy all copies in your possession.
This Agreement is governed by the laws of the Province of British Columbia, Canada. Disputes shall be resolved in the courts of British Columbia, Canada.
These Terms & Conditions govern your purchase and use of Show Caller software provided by Smith Creative Technology, 3620 Quadra St., Victoria, B.C. V8X 1H4, Canada.
By purchasing or using Show Caller, you agree to these Terms. If you do not agree, do not purchase or use the software.
Purchases are processed by Paddle.com Market Limited ("Paddle"), who acts as our Merchant of Record. When you purchase Show Caller, you are purchasing from Paddle, subject to their terms of service. Paddle handles all payment processing, tax collection, and VAT compliance worldwide.
All prices are listed in USD. Paddle will display the equivalent in your local currency at checkout. Prices are subject to change. Your renewal price will be confirmed before your license renews.
We offer a full refund within 30 days of purchase if Show Caller does not work as described on your hardware. Email support@showcaller.io with your order details. We strongly encourage you to use the 14-day free trial before purchasing.
Paddle collects and remits all applicable taxes, including VAT, GST, and sales tax, on our behalf. The applicable amount, if any, will be displayed at checkout.
Your license is annual. We will notify you by email before your renewal date. You may cancel auto-renewal at any time by contacting support@showcaller.io or through your Paddle customer portal. Cancellation takes effect at the end of your current license term.
The 14-day free trial provides full access to all features. No payment information is required. The trial ends automatically — you will not be charged unless you choose to purchase.
Show Caller is licensed for lawful live event production use only. You may not use Show Caller for any unlawful purpose.
Show Caller and the Show Caller logo are trademarks of Smith Creative Technology. All rights reserved. Nothing in these Terms grants you any right to use our trademarks.
To the maximum extent permitted by law, Show Caller is provided "as is." We make no warranties regarding uninterrupted or error-free operation. Your use of Show Caller during live events is at your own risk.
Our total liability for any claims arising from these Terms or your use of Show Caller shall not exceed the amount you paid in the twelve (12) months preceding the claim.
We are not liable for failure to perform due to causes beyond our reasonable control. If such an event prevents Show Caller from operating for more than 30 consecutive days, you may request a pro-rated refund for the unused portion of your license term.
Show Caller may not be used in violation of applicable export control laws or sanctions. By purchasing, you confirm you are not located in a sanctioned territory and are not on any government restricted party list.
We reserve the right to update these Terms at any time. We will notify you of material changes by email. Continued use of Show Caller after changes constitutes acceptance.
These Terms are governed by the laws of the Province of British Columbia, Canada. Disputes shall be resolved in the courts of British Columbia, Canada.
